No Vacation from Retaliation:  The Rhyme and Reason Behind Effective Prevention Strategies

Have you ever had an accused supervisor confront a complaining employee about his or her complaint?  How does an employer properly address this situation?  What happens when a complaint is unfounded and not a violation of law, but the accused is still treated differently after complaining?  Does that treatment constitute retaliation?  These questions and more will be answered in an informative discussion of how to grapple with retaliation in the workplace.  For nine consecutive years, retaliation claims have been the leading category of charges filed with the EEOC.  Due to the potential costly liability, employers should be proactive in preventing and responding to retaliation claims by encouraging a positive compliance culture, conducting effective workplace investigations, and avoiding and defending against claims of retaliation.


More about our Speaker:  

Tevis Marshall is a founding member of Ogletree Deakins’ Richmond office and focuses his practice on all aspects of traditional employment law. He regularly counsels employers on a broad range of workplace issues, including regulatory compliance, personnel policies, hiring, disciplining, terminating, reasonable accommodations, FMLA leave and workplace investigations. He has also assisted clients in managing onsite investigations from the EEOC and the U.S. Department of Labor.

In addition to advising employers on workplace issues, Tevis has litigated cases on a wide range of topics, including discrimination, harassment, retaliation, Title VII, the Americans with Disabilities Act (ADA), the Age Discrimination in Employment Act (ADEA), overtime and wage violations under the Fair Labor Standards Act (FLSA), the Family Medical Leave Act (FMLA), the Employee Retirement Income Security Act of 1974 (ERISA), non-compete agreements, wrongful termination and other general employment matters.
